To access the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You must be at least 13 years old to create an account.
Circle365 allows you to create and manage family circles. You may only add family members or individuals with their explicit consent. You are responsible for ensuring all circle members have agreed to be tracked and monitored through the Service.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
The Service requires access to your device's location services to provide real-time location sharing. You must enable location services and grant the necessary permissions for the Service to function properly.
By using the Service, you consent to sharing your location with other members of your family circle. You may only share location data with individuals who have explicitly agreed to be part of your circle.
The Service collects driving data including speed, braking patterns, and phone usage while driving. This data is used to provide driving analytics and safety insights. You consent to this data collection when using the Service.

The Service includes automatic crash detection features. While we strive for accuracy, crash detection is not guaranteed and should not be relied upon as the sole means of emergency response.
In the event of a detected crash, the Service may automatically contact emergency services and notify family members. You consent to this automatic emergency response feature.
Circle365 is not responsible for the response time or quality of emergency services. Emergency response is subject to local emergency service availability and capabilities.
You retain ownership of content you share through the Service. By sharing content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content in connection with the Service.
All content provided by Circle365, including safety features, analytics, and platform functionality, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our permission.
Basic access to the Service is provided free of charge with limited features including basic location tracking and circle membership.
Premium memberships (Circle Gold and Circle Platinum) require payment of subscription fees and provide enhanced features including advanced analytics, multiple location alerts, and crash detection. All fees are non-refundable except as required by law.
Premium subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or the App Store.
Your privacy is critical to us. We will never sell, share, or give away your personal data to third parties. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your information.
The Service requires an active internet connection and GPS signal to function properly. Service availability may be affected by:
We may terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting the app or contacting us. Upon termination, all location and driving data will be permanently deleted.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CIRCLE360 IS NOT A SUBSTITUTE FOR PROPER SUPERVISION OR EMERGENCY SERVICES.
IN NO EVENT SHALL CIRCLE360 BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. CIRCLE360 IS NOT LIABLE FOR ANY DAMAGES ARISING FROM THE USE OR MISUSE OF LOCATION DATA, DRIVING ANALYTICS, OR EMERGENCY FEATURES.
You agree to indemnify and hold harmless Circle365 from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or misuse of location or driving data.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on the Service or through other reasonable means. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
